6. 125-18 : Appoint Paul Allen as a Member of the New York State Open Space Regional Advisory Committee - NYSDEC Adopted [Unanimous]

7. 126-18 : 2018 Budgeted Payments to Cortland County Soil & Water District Adopted [Unanimous]

              WHEREAS, the 2018 Adopted Budget appropriated the sum of $285,093 to be paid to the Cortland County Soil and Water Conservation District for the expense of maintaining said district and assisting the district in carrying out the provisions of the Soil Conservations Districts Law, AND

 

              WHEREAS, Section 223 of the County Law authorizes such payments to be made upon adoption of a resolution directing the County Treasurer to make such payments upon certain terms and conditions, NOW THEREFORE BE IT

 

              RESOLVED, that pursuant to Section 223, Subdivision 1 of the County Law, the County Treasurer, upon audit approval, be and hereby is directed to pay the sum of $285,093.00 (Account Number A87105 54850), in 4 quarterly payments in the amount of $71,273.25 on or before  03/31/18, 06/30/18, 09/30/18 and 12/31/18 to the Cortland County Soil and Water Conservation District to be used for the maintenance of said conservation district in carrying out the provisions of the Soil Conservation Districts Law, AND BE IT FURTHER

 

              RESOLVED, that at any time during 2018, the Chair of the Legislature may request the Directors of the Cortland County Soil and Water Conservation District to submit a report in writing of a detailed statement of its work and transactions for the preceding year and for any other period of time requested.

8. 127-18 : Approve Airport Hangar MH-2 Lease - Highway Department Adopted [16 to 1]

WHEREAS, Cortland County currently owns, maintains and leases various hangar buildings and spaces at Cortland County Airport on a monthly basis, AND

 

WHEREAS, in accordance with Local Law No. 5 of 2012, the County has negotiated with McNeil & Company, 22 Church Street, Cortland, NY 13045 for the lease of a portion of Hangar Building MH-2 at Cortland County Airport, AND

 

WHEREAS, the Airport Advisory Board unanimously approved a motion recommending that the Cortland County Legislature approve the lease of a portion of Hangar  MH-2 with McNeil & Company, 22 Church Street, Cortland, NY 13045, containing the following terms and conditions:

 

Rental Rate Schedule:

 

•              Year 1 (January 1, 2018 to December 31, 2018): $1,100.00 per month,

•              Optional Year 2 (January 1, 2019 to December 31, 2019): $1,200.00 per month.

 

Terms and Conditions:

 

•              All other terms and conditions of the previous Lease for Hangar MH-2 with McNeil & Co. shall apply.

 

, AND

 

WHEREAS, the Highway Committee of the Cortland County Legislature recommends approval of a lease of a portion of Hangar MH-2 at Cortland County Airport to McNeil &­ Company, 22 Church Street, Cortland; NY 13045, in accordance with the Rental Rate Schedule,. and Terms and Conditions as stated above, NOW THEREFORE BE IT

 

RESOLVED, that the Legislature hereby approves the lease of a portion of Hangar MH- 2 at Cortland County Airport to McNeil & Company, 22 Church Street, Cortland; NY 13045, in accordance with the Rental Rate Schedule, and Terms and Conditions as stated above, AND BE IT FURTHER

 

RESOLVED, that the Chairman of the Legislature, upon review and approval by the County Attorney as to form, is hereby authorized to execute the necessary Hangar Lease Agreement with McNeil & Company, 22 Church Street, Cortland, NY 13045, for lease of a portion of Hangar MH-2 Building at Cortland County Airport in accordance with the Rental Rate Schedule, and Terms and Conditions as stated above.

WHEREAS, the County of Cortland has been awarded a NYSDOT Aviation Capital Grant to construct a new Jet-A-Fuel System at the Cortland County Airport, GEN. Levi R. Chase field, AND

 

WHEREAS, the design of and construction of the Jet-A-Fuel System Project (NYS PIN 3903.08) was approved by the Cortland County Legislature by Resolution 452-16, AND

 

WHEREAS, an amount of $495,000.00 for the construction and construction administration/inspection of said project has been approved by the NYSDOT, and the said funds were budgeted but not expended in the 2017 County Capital Project Budget, AND

              WHEREAS, Resolution No. 258-13 gave the Cortland County Health Department permission to enter into an agreement with the New York State Department of  Health to continue the Cancer Services Program, Contract # C-028812 for the contract period of 7/1/13-6/30/18, AND

WHEREAS, New York State is engaged in a significant effort to address the rising rate of substance use disorders (SUD), including the epidemic of opioid and heroin addiction and the increasing number of deaths due to overdose, AND

 

WHEREAS, the link between criminal offending and substance use disorders  is well established, bringing significant numbers of individuals suffering from addiction into county jails, AND

 

WHEREAS, alcohol and drugs are implicated in roughly eighty (80) percent of offenses, including domestic violence, DWI’s, property offenses, drug offenses, and public-order offenses, AND

 

WHEREAS, according a report conducted by Policy Research Associates on behalf of the NYS Conference of Local Mental Hygiene Directors entitled CLMHD Full Report Completing the Recovery Treatment Continuum FINAL, dated January 9, 2018, New York County Sheriff’s indicated that of the individuals detained in their jail on drug-related charges, sixty-eight (68) percent had been in their jail before, AND

 

WHEREAS, a comprehensive re-entry and transition plan is critically important to minimizing the possibility of overdose, connecting individuals to treatment at discharge and reducing recidivism, and has been identified as a priority community need through the Cortland County Sequential Intercept Mapping Report, NOW THEREFORE BE IT

 

RESOLVED, that the Health and Human Services and Judiciary and Public Safety Committees and the Cortland County Legislature calls on the Governor and the Office of Alcoholism and Substance Abuse Services to help combat the heroin and opioid epidemic by authorizing funding of $12.8 million annually to the Local Government Units of New York State to address the existing gap in the SUD treatment continuum while individuals are in county jail  and support efforts to reduce the human cost of the heroin/opioid epidemic on New Yorkers, and reduce jail recidivism and community victimization, AND BE IT FURTHER

 

              RESOLVED, that the Clerk of the Legislature is hereby directed to forward copies of this resolution to Governor Andrew Cuomo, Comptroller Thomas DiNapoli, Attorney General Eric T. WHEREAS, chief among the things that can be done quickly to increase the safety of our children and their schools is to provide an armed police presence in the schools, AND

 

WHEREAS, due to budget constraints, tax caps and limited sources of revenue, it is beyond the fiscal capability of many school districts and other local government entities to fund the placing of an armed police officer in every school, AND

 

WHEREAS, the current threat to the safety of our children in their schools is a public safety emergency requiring a statewide response by our state government, with its multiple revenue sources, to address this emergency, NOW THEREFORE BE IT 

 

RESOLVED, that the Cortland County Legislature does hereby support the New York State Sheriffs’ Association in its call for the state funding of an armed school resource officer in every elementary and secondary school in New York State, and does hereby call upon the New York State Legislature and the Governor to include in the 2018 Annual State Budget funding for that purpose.
